UPON considering the Claimant’s Application No. CFI-054-2018/22 dated 2 March 2022 for an extension of time to file the Claimant / Respondent’s substantive responsive skeleton, in the appeal case, in the event permission to appeal is granted (“First Extension of Time Application”)

AND UPON considering the Claimant’s Application No. CFI-054-2018/23 dated 2 March 2022 for a retrospective extension of time until 28 February 2022 to file its responsive submissions, pursuant to Rule 44.14 of the Rules of the DIFC Courts, against the Defendants’ permission to appeal application (the“Second Extension of Time Application”)

AND UPON reviewing the Defendants’ letter sent by email to the Registry on 2 March 2022

IT IS HEREBY ORDERED THAT:

1. The First Extension of Time Application is granted and the deadline for the Claimant/ Respondent to file its substantive responsive skeleton in the appeal case, in the event permission to appeal is granted, is extended for a period of 28 days from the date in which permission to appeal is granted (in other words, from the date of the permission order).

2. The Second Extension of Time Application is granted and the deadline for the Claimant/Respondent to file its submissions against the permission application is retrospectively extended from 25 February 2022 to 28 February 2022.

3. A late filing penalty fee of $200 shall be imposed on the Claimant to be paid within 14 days from the date of the relevant invoice.

4. Costs of the First Extension of Time Application are costs in the case.

5. The Defendants are entitled to their costs of the Second Extension of Time Application to be immediately assessed upon the Defendants’ provision of a Statement of Costs (“Statement”) to be filed and served within 7 days from the date of this Order. The Claimant will have 7 days to provide its brief response, if any, to the Defendants’ Statement.
